1. Introduction Welcome to the Iterli application! Iterli is an innovative digital platform designed specifically for "passengers" and "drivers" to facilitate transportation and ride organization. The app allows passengers to easily create trips, and drivers can quickly respond to ride requests. Efficient communication between users is ensured through the app's built-in messaging system, which promotes smooth interaction and the exchange of essential details. Iterli uses Google Maps, enabling passengers and drivers to track each other's location in real time, which helps with planning meeting points. The app also guarantees secure payment: through Stripe Connect, passengers can conveniently and reliably settle the fare, which is calculated based on the distance traveled, and transactions are processed after the ride concludes. Iterli provides all of this on a single user-friendly platform, making travel simple and hassle-free. By using the Iterli app, users accept the terms defined here and agree to comply with them. Iterli reserves the right to modify these terms at any time, with notifications sent to users.
User Agreement: To use the Iterli app, users must read and accept the terms of use. Using the app establishes a user agreement that applies to both passengers and drivers.
⦁ User Types: The Iterli app has two primary user roles: "passenger" and "driver."
⦁ Creating a User Account: To use the app, users must provide the following mandatory and optional information:
⦁ Email address (mandatory)
⦁ Username (mandatory)
⦁ Year of birth (mandatory) – users under 18 are not allowed to use the app.
⦁ Password (mandatory)
⦁ Picture/Avatar (optional)
⦁ Passengers are required to provide basic information, while drivers must provide additional details, such as the vehicle's type, license plate, and color, to ensure smooth service. Passengers can create trips, which drivers can accept, and payments are processed via Stripe Connect. Drivers must register with Stripe Connect to handle payments for rides. The data entered during the Stripe registration is sent directly to Stripe, ensuring data security and processing.
⦁ Fare Estimation: When passengers create a trip, a preliminary fare estimate appears based on the set distance, allowing both passenger and driver to view the expected costs in advance.
⦁ Final Pricing and Payment: Upon completion of the trip, the app automatically calculates the final fare based on the actual distance traveled and the number of passengers. This amount is paid by the passenger at the end of the trip, upon disembarkation. During the payment process, the passenger settles the total calculated amount, which includes the fare for the trip.
⦁ Service Fee Deduction: The Iterli service fee, which is 13.8% of the amount paid by the passenger, is automatically deducted through the Stripe Connect system. As a result, the amount displayed in the app for payment to the driver already reflects the 13.8% commission deduction. This amount includes the fees for Stripe and the platform provider.
⦁ Payment: All payment transactions are conducted through Stripe Connect, which handles the storage and processing of card details. The company assumes no responsibility for any payment issues.
⦁ Refunds and Complaints: In case of complaints, passengers and drivers can report the issue via a private chat wall accessible under the "Contact" button in the "Info" tab, with responses provided within three business days. Responses will be visible under the same window in the app. Refund requests are handled on a case-by-case basis, and notifications are sent within the app. The refund process complies with Stripe's policies, and the conditions for refunding transaction costs depend on Stripe's terms.
⦁ The app allows for messaging between passengers and drivers. Messages are stored in the database according to the specific trip's identifier. Messages are retained only as necessary to provide the service, and appropriate security measures are taken to protect user data.
⦁ Stored messages are not used for marketing purposes and are only released to third parties if required by law or to protect users (e.g., in legal disputes). Iterli is committed to the secure and responsible handling of data, ensured through regular privacy audits and security updates.
⦁ Data Security: Messages and location data are protected in accordance with GDPR requirements. Data is stored until the end of the ride or as required by law and then deleted or anonymized once the purpose of data processing ends.
⦁ Location Tracking: The app uses GPS technology to allow users to view each other's location during the ride. The location data of both passenger and driver is transmitted in real time to facilitate meeting point planning and navigation. Location data is used exclusively during rides and managed in compliance with strict data protection rules.
⦁ Location Accuracy: The accuracy of the GPS-based service depends on external factors such as signal strength, and minor deviations may occur.
⦁ Drivers are required to ensure that their vehicles are safe and operational, meeting all relevant traffic and safety regulations. This includes: ⦁ Required Permits: Drivers must have a valid driver's license, and their vehicle must meet the technical requirements set by local traffic authorities.
⦁ Insurance: Law requires all vehicle owners to have proper insurance coverage for accidents or damages that may occur during rides, providing adequate protection for everyone involved.
⦁ Compliance with Traffic Rules: Drivers are required to obey traffic laws, such as speed limits, road signs, and traffic safety regulations.
⦁ The application operator makes every effort to ensure continuous and error-free service operation; however, the service is provided "as is," meaning that the app is not responsible for:
⦁ Delays or Outages: Temporary unavailability of the app or service due to technical issues, maintenance, or other reasons beyond the app's control. ⦁ Injuries and Damages: The app is not responsible for any personal injuries or property damage that may occur during rides.
⦁ Updating Terms: The app reserves the right to modify or update the terms at any time. Users will be notified of the new terms, and accepting the changes is necessary for continued service use.
⦁ Account Suspension or Termination: The app reserves the right to suspend or delete users' accounts if they violate the terms of service. This includes, but is not limited to, misuse, fraud, harassment of other users, disrespectful or inappropriate behavior, or any actions that endanger the safety of others.
⦁ Acceptable Conduct: Users are prohibited from using the service for any illegal, disruptive, or dangerous activities. This includes disrespectful behavior between drivers and passengers, items transported by the driver, and inappropriate behavior within the vehicle. In case of any violation or disorderly conduct, the user's account may be immediately suspended.
⦁ Third-Party Services:The application utilizes functions and data provided by third parties, such as the Stripe payment system and Google Maps mapping service. These services are the responsibility of the respective third party, and the application is not liable for errors, delays, inaccuracies, or unavailability of services provided by third parties. Users use third-party services in accordance with their own terms of service and privacy policies.

⦁ Dispute Resolution: The app operator aims to resolve all disputes amicably. A private messaging interface is provided for users to manage complaints and feedback, with responses within three business days. If amicable dispute resolution is not possible, legal disputes will be settled in the appropriate court.
⦁ Copyright and Intellectual Property: All content, including the app design, logo, and other intellectual property, is protected and may not be copied or used without permission. ⦁ Legal Disclaimer: The app operator is not responsible for events outside the app's operation. These include, for example, natural disasters, war events, technical failures, or other circumstances that may prevent the provision of the service. The app operator makes every effort to ensure uninterrupted operation, but in case of such events, service suspension, delay, or shutdown may be unavoidable.
